July 3, 2007
1.0 Assembly
1.1 Members Present: Jack Sheehy, Tom Marshall, Nan Schwartz, and Ken Eastman
1.2 Alternates Present: Dennis Kelly and Frank Musmanno
1.3 Members & Alternates Absent: Lynn Cook, Bill Cole and Fran Greene
1.4 Visitors: Douglas E. Kellogg, John Burrows (representing Brian and Pam Vaillancourt), Suzanne Horner, Joan Kellogg, Bob Bachand and Deb Arnold
Marshall motioned that Musmanno sit in for Cook. Schwartz seconded the motion. All voted in favor.
Musmanno motioned to approve the minutes as written. Schwartz seconded the motion. All voted in favor.
2.0 Driveway Permits
2.1 Bob Gilliland – TM#16-093, East Washington Road. Sheehy advised that he had visited the site and approved the driveway. The Road Agent approved the driveway with comments. The Planning Board discussed the condition of the Selectmen not approving a building permit until the culvert mentioned by the Road Agent has been addressed. Eastman to advise the Selectmen.

4.0 Old Business
4.1 Bill Royce, Horner Minor Subdivision Application, TM#11-038, Old Marlow Road. Royce provided the Board of his site plan. Sheehy asked if there were any covenance to building on the property. Royce advised that there were not. Schwartz asked for a copy of the deed. Royce advised he did not have it with him. Sheehy advised two copies of the deeds would be needed. Schwartz asked if there was a driveway permit. Royce advised he would need to apply for one. The Board advised that #17 setback line & #18 square feet as well would need to be shown on the plans along with the abutters. C topographic maps in interim of five feet. The Board advised Royce that the application cannot be accepted as complete until these issues have been addressed and to contact the Board when he is complete.
4.2 Vaillancourt Subdivision – TM#16-071, John Burrows provided the Board with a site plan for review advised the VaillancourtÕs propose four new lots along with their one lot. Burrows advised that the Vaillancourt's have received State approval for the septic systems. Sheehy asked for the square footage on each lot. Eastman asked about the driveway materials because of the washout concerns at this point of the road. Burrows advised a 20 x 20 paved apron. Discussion regarding utility easement. Sheehy define driveway and septic #2 inset does not match map. Lot #3 does driveway go over septic? Lafferty listed but not on the map. Show the setback lines.
4.3 Subdivision Application Guide – final review
4.4 Talking points on development – Schwartz made a list of Conservation Easement Contacts and Information.
4.5 Ashuelot Watershed Ordinance – Board to forward to UVLSRPC and Jody Connor.
4.6 Bob Bachand – Asked the Board for further guidance to start his site map. The Board provided him the necessary information. Bachand discussed his sign permit. Bachand was advised he would need a business permit.
4.7 Deb Arnold- Provided the Board with a plan for her lot line adjustment. Arnold was advised that she would need to have an attorney draw up two new deeds with the new acreage.
5.0 New Business
5.1 Ed Thayer – Discussed Town road status. Kelley asked if the Town can change the status of a Town road. Thayer advised that the Planning Board has the right to establish a betterment assessment. Thayer advised the Town at Town Meeting could vote to upgrade a road. Sheehy asked about the other property owners on these roads. Thayer advised that the Town has the owners beyond that point they would share in the assessment. Marshall asked about Ayers Pond Road the Planning Board has the right to ask to upgrade the road to vehicular traffic. Thayer advised that State law allows the Town the planning board can assess the road is not adequate and the road should be made safer. Impact fee ordinance or part of the subdivision process. Turn road from V to revert to Class VI abandoned for five years. Class V Summer Maintenance Only is the same as Class V road. Selectmen have the full authority to limit road. Class VI to trails would have to be at Town Meeting. Sheehy asked about building on class V roads summer maintenance. Thayer advised that these issues should be brought forward at Town Meeting for public view.
5.2 Capital Improvement Plan – Sheehy advised that the Improvements would be due August 15th.
5.3 Eastman provided the number of new home building permit for the past ten years. Schwartz to study surrounding towns #Ős.
5.4 Building Task Force update Kelley advised that the interview process is done. Conservation Commission needs to be spoken to. Police Chief and Fire Chief needs. Process is stalled.

6.6 UVSRPC – invoice for 2007 dues. – Filed
6.7 Town and City Magazine. – Filed
6.8 Sue Fitzgerald- Sign permit. Eastman motioned to approve the sign permit. Schwartz seconded the motion. All voted in favor.
7.0 Next Planning Board meeting, August 7, 2007 Time 7:00 PM in the Town Hall.
