Public Hearing – August 2, 2011

0.4 Visitors: Tim Callendar, Peter Mellen and Jean Kluk 

Cook motioned to open the Public Hearing at 6:05PM.

Crandall motioned that Terani sit in for Chute. Marshall seconded the motion. All voted in favor.

Tim Callender, Annexation, Millen Pond Rd, TM 11-11 annexing 15,405 sq ft to Brockway TM 15-114. Resulting in a lot with 133' frontage on Millen Pond Rd. and an area of 33,108 sq ft or .76 acres (after merger).

The Board reviewed the application for completeness. There was discussion regarding an easement in the deed. Mellen said once you own the land the easement is extinguished because it is no longer necessary to have one. Cook asked for Board comments. Cook asked for a motion from the Board. Schwartz motioned that the application for annexation be accepted as complete. Marshall seconded the motion. All voted in favor.

Callendar said that the conversation between the two parties was a 8-foot easement not 7-foot. Mellen said that the difficulty is speaking to both parties not in the same room and given this disagreement presented here tonight, I would like to continue until next month's meeting. Marshall motioned to continue the meeting until next meeting. Schwartz seconded the motion. All voted in favor.
